提单是国际货物买卖中的重要单据之一,它具有货物收据、物权凭证、运输契约或运输契约证明三重身份,也是交接货物、处理索赔和理赔以及向银行结算货款或进行议付的重要单据。一般来说,繁式提单的背面都有大量的条款,由于各个船公司援引的国际公约不同,提单的条款也大相径庭。不注意这些条款,就有可能遭到不必要的麻烦,甚至是损失。
The bill of lading (B/L) is an important document in international cargos transaction. It serves as a receipt for cargos, an evidence for the property right, and a deed or evidence for transportation. Also, it is an important document for handing/taking over cargos, handling and settling claims, settling accounts of banks or negotiating for payment. Generally speaking, there are a number of articles at the back of the long-form bill of lading, as international conventions quoted by different shipping companies differ, so do the articles of the billing of lading. Without paying attention to these articles, interested parties may suffer unwanted troubles or even losses.
