法的本源新探

DELVE FURTHER INTO THE ORIGIN OF LAW

法从何而来的问题是解决法的本质问题的基础。尽管学术界目前对这一问题的认识趋于一致,但仍有可探讨的空间。笔者以为:一定社会生活条件下的人们的利益或需要和对利益或需要的分配及调和是法的最终动因。法的非根源性因素是人类的思维、意识、思想等精神性因素。法的物质性和思想性根源的不同组合构成世界各国丰富多彩的法律形式。法最初的形式来源是习惯。

Where law comes from is the foundation for solving the essence of law. Althougn academic circles hold identical views on this very problem, there is still room for enquiring into it. The author thinks that the final cause lies in people’s benefits or needs and the distribution and the coordination of people’s benefits and needs in a certain living conditions. Law’s non original factors are spiritual ones, such as thought, consciousness and idology. The different makeup of the origin of law materiality and ideological content makes up rich and colorful law forms of the countries all over the world. Law’s initial forms came from customs and habits.
