摘要
由于传统上对死刑执行程序的理论基础的认识存在不足,本文主张应该以死刑的准确性、时效性和人道性三个方面构建新的理论基础。同时,文章从死刑执行根据、死刑执行主体、死刑执行阶段权利救济的程序、执行死刑核准程序、执行死刑命令签发程序、死刑缓期执行程序的变更等方面探讨了死刑执行程序完善的若干建议。
This paper,based on the accuracy,validity and humanity of meting out capital punishment,attempts to improve the traditional theory of capital punishment,which is deficient in some ways.The author offers suggestions as to the improvement of the gronds for implementing capital punishment,of the subject of implementing capital punishment,of the relief procedure of ringis in the stage of implementing capital punishment,of the approving procedure of implementing capital punishment,of the empowering procedure of implementing capital punishment,and of the reprieve procedure of implementing capial punishment.
