论电子签名立法的若干问题

The Legislation of Electronic Signature

随着电子商务的快速发展,电子签名已成为保障电子交易安全的必不可少的工具。但是,电子签名的立法目前还处于相对滞后的阶段。在国际上许多国家,国际组织纷纷对此立法的情况下,我国也相继出台了一些法规对此进行规定,但仍需要进一步的完善。因此,从分析电子签名这一技术入手,对有关国家,国际组织的立法进行分析比较,进而推进我国电子签名立法的早日出台。

As electronic commerce develops quickly,electronic signature has become one of the most important tools to secure electronic transactions.But conversely,the legislation in electronic signature remains stagnant .When many countries and international organizations start enforcing laws in electronic signature,Chins should also put up some corresponding laws.With an introduction to electronic signature,the paper tries to analyze,the legislation in the world, and make an attempt to raise some proposals for electronic signature in China.
