摘要
寻租理论是一种利用租金投入对资源配置进行再分配的经济分析模型,运用这一分析模型可以对法律资源中的私权与公权之间的合理配置进行有效的经济解释。私权与公权的均衡状态需要两者不断地利用现存的非均衡的制度状况进行寻租活动以求获得利益,使资源配置向有利自身的方向倾斜,最终结果是权利资源和权力资源在相互转化中得到重新配置。在我国,由于法律制度资源配置不合理,公权强势于私权,从而导致大量的制度性租金产生。因此,只有确立私权利的优先位置,才能使过剩的公共权利资源向私权利转化。
Theory of Rent-seeking is an economic analysis model that utilizes rent input to reallocate resources distribution. Using this analysis model, we can go on an effective economic explanation of the rational disposition between the private and public right of law resources. The balanced state of private right and public right needs the two to utilize the extant non-balanced state to carry on seeking and renting in order to acquire an advantage constantly, makes resources distribution slope in favor of one's own direction, and the final result is that the right resources and power resources are reconfigured in the process of mutual transformation. In our country, because the legal system resources are unreasonably distributed, the public right is more advantageous than private right, which causes a large amount of institutional rent. Therefore, only by establishing preferential position of private right, can make surplus public right resources transform into the private right.
