摘要
公务员法凸现了对于公务员知情权、救济权等基本权利的保障;通过对程序正当的追求、违法责任条款的设置,以及问责制的设立,体现了责任行政理念;在制度弹性化、能力建设等方面也有所创新。但关于公务员范围的界定有待商榷;关于公务员流动的规定有悖专业化管理精神,可能加重国有企事业单位的官本位意识;在职务划分、绩效考核、激励等环节都有进一步提升的较大空间。
According to the law, civil servants will have more rights to protect their personal interests while taking more responsibility; should take the blame and quit their posts if their mistakes or negligence cause major losses or seri ous social repercussions. The legislation shows principles of responsibility adm inistration and flexibility. However, there are some issues need to be discussed , such as the concept of civil servant, job analysis, performance valve, ways of stimulation etc.
