摘要
规范的有效性包括法律效力、道德效力、现实效力几个纬度。本文以禁乞令为例对规范的有效性所涉及的这几个纬度进行了探讨。“禁乞令”对行乞者的乞讨自由权构成了限制。这种限制尽管是出于管理者对于某些公共政策如维护公共秩序和城市形象等方面的考虑,但是仍然在其规范有效性问题上遭到质疑。
The validity of norm includes several dimensions: legal validity, moral validity, actual effect. This article analysis's these dimensions of validity of the statutes that forbid begging. These statutes restrain freedom of beggars. The restraint is questioned the validity, even though some public policy were considered by the government, such as public order.
