摘要
关于共同正犯个别中止问题,存在着客观说(既遂说)、主观说(中止说)以及折衷说(未遂说)之争。长期以来,学者对于主观说的论证均局限于行为人主观恶性减少、刑法的期待可能性以及中止犯立法意图等范畴之内,回避了单独犯罪与共同犯罪的中止认定标准的理论同一性问题,使该点成为备受折衷说攻击的理论弱点。本文从既遂、中止和未遂的分界入手,试图通过对中止犯有效性进行重新解释,解决单独犯罪与共同犯罪中止认定标准的理论同一性问题。
In a long time, there are different ideas about how to found to the discontinuance of joint principal offender's crime. In the author'opinion, if someone eliminate their influence on the other joint principal offenders and break away from them, they should not be responsible for the subsequent result of other joint principal offenders and their action belong to discontinuance of joint principal offender's crime. In order to understand the discontinuance of joint principal offender's crime better and try to improve legislation and justice concerning crime discontinuance; the anthor try. to make a deep research on the discontinuance of joint principal offender's crime in this article.
