摘要
听证作为一项体现公开、公正、民主的法律程序,孕育着对社会公益的保护。在我国,听证制度既有宪法依据,又有法律根据。为加强听证对社会公益的保护,应拓宽听证程序的适用面,扩大听证公众的参与面,遵守听证的法定程序和依据听证笔录进行决策。
Hearing, an important legal system which contains opening, justice and democracy, comprises a protection to social pubic interests. In China, there are a constitutional base and a legal foundation. In order to strengthen the protection of the hearing to the social pubic interests, applicable scope of the hearing should be expanded, range of the pubic to attend extended, legal procedure about the hearing obeyed, judgment made by notes of it.
