摘要
研究目的:随着城市土地利用立体化,城镇住房商品化,区分产权问题是城市土地使用者和城镇居民都要面临的实际问题,研究不动产区分产权及其登记制度具有十分重要的现实意义。研究方法:归纳与演绎法。研究结果:区分产权是物权法中特殊的物权形式,是空间产权的重要组成部分。研究结论:区分产权制度一方面是解决城镇高层住宅所有权归属的特殊制度,另一方面也是解决地表上下一定空间利用权归属的特殊制度;笔者主要探讨了建筑物区分所有权、区分地上权及其登记制度。
With the increasing use of urban land and the commercialization of urban h ousing,the problem of the property dividing right has become a realistic issue faced by both urban l and users and residents.The paper aims at the property dividing right a nd its registration system which has great significance.Methods of induction and deduction were employed.The pro perty dividing right is a special form in property right law.The property dividing right system is on one hand p lanned to solve the attribution of th e ownership of urban high-rise dwelling buildings,and on the other hand,it i s used to solve the attribution of the use of certain space on the earth' s surface.This article mainly explores the condominium ownership,the su perficies right of space and their re-gistration systems.
