摘要
2005年2月24日,国务院发布的《关于鼓励支持和引导个体私营等非公有制经济发展的若干意见》明确提出了放宽非公有制经济市场准入限制、加大对非公有制经济的财税金融支持等鼓励、支持和引导非公有制经济发展的七大政策措施。《意见》的发布,对于进一步贯彻落实中共十五大特别是十六大以来关于鼓励和促进非公有制经济发展的一系列方针政策,落实2004年宪法修正案关于完善保护私有财产法律制度的要求,切实解决我国非公有制经济发展面临的观念、法律、体制等方面的困难和问题,具有非常深远的现实意义和历史意义。为此,本刊特开辟专栏--"非公有制经济的平等保护",约请知名法学专家、学者就此问题从法律的角度进行探讨。
On February 24th 2005, seven policies, which encourage, sustain and induct the development of non- public sectors of the economy were clearly brought forward in 'some opinion on encouraging, sustaining and inducting the development of non-public sectors of the economy such as individual and private economy which is constituted and pro- mulgated by State Department. Its promulgation has great realistic and historic meaning on ulteriorly carrying out the poli- cies of encouraging and accelerating the non-public sectors of the economy development from the 15th congress and espe- cially the 16th congress, fulfilling the request on perfecting the law of safeguarding the private property in constitution a- mendment, solving the difficulty and problem of opinion, law and system faced by the development of non-public sectors of the economy in China. So the column of 'equal guarantee of non-public sectors of the economy' is put forward, and some famous legalists were invited to discuss this problem.
