我国彩票业法制建设回顾与立法思考

The Review and Thinking of Lawmaking and Legislation in Lottery Ticket in China

采用文献资料及逻辑分析法,回顾了我国彩票业法制建设的历程,分析了我国彩票业的属性和彩票业管理和监管现状,以及目前我国彩票业存在的问题和未来发展趋势。结果表明,彩票业立法的相对滞后,造成了彩票经营中各种法律纠纷不断出现,信誉降低。最后对我国彩票业立法进程、立法要点、立法内容等相关问题提出了几点思考,为保障今后我国彩票业健康发展,提出组建中国彩票监督管理委员会、建立维护彩票信誉的保障机制、建立健全彩票法律体系等对策。

In this paper, the authors reviewed the process of lawmaking in lottery ticket, and analyzed the present situation and the problems of the industry of lottery. The results showed that the lawmaking of lottery ticket is back and made the legal dispute often occurred. In order to maintain the healthy development of lottery ticket, people of all circle appeal establish and promulgate 'the law of lottery' rapidly. Finally the article provided several counter plans and considerations on lawmaking and healthy development of lottery ticket in China.
