由于尚未达成规范国际性限制竞争行为的统一规则,一些国家通过其反垄断法的域外适用加以规制,各国立法或判例中形成了一些反垄断法域外适用的原则。但由于这些原则的缺陷以及各国在管辖权问题上态度的差异,造成了反垄断法域外适用的冲突。要解决这一问题,需要进行单边和多边的协调。

Since there are not uniform rules governing international anti-competition actions,some countries applied their own antitrust laws overseas.Principles of applying antitrust law overseas appeared in some countries' statute laws and prejudications.But these principles have their own defects and different countries' attitudes to jurisdiction varies,which results in conflicts of antitrust law's overseas application.Unilateral and multilateral coordination are needed to solve the problem.
