当代中国法治化进程中所应重视的几个问题

Problems during the Process of Constitutionality in China

本文对中国法治化进程中存在的基本问题进行了分析和探讨,指出当代中国法治现代化过程中所需要注意的一些隐患。这些问题主要表现为中国在借鉴和移植西方先进法律制度时,人们常常忽视了彼此法治模式的背景、改革路径、市场环境、社会结构等方面的差异,致使法治的正统性和合理性产生危机;在法治化进程中,人们常常曲解了道德与法的内在统一性,致使道德泛法律化,从而偏离法治的方向;最后,文章指出中国在法治化进程中不应忽视“正当程序”的价值功能,应借鉴西方法治实践的成果,重视程序法的构建和完善,以期顺利实现中国的法治现代化。

This text analyzed the basic problems existing in the process constitutionality, pointed out some hidden dangers in constitutionality modernization.While learning and transplanting the western advanced legal system, people oftenignore the differences in background of mode governed by law, in the reform path,in the market environment and in social structure, to cause the crisis of orthodox and rationality of constitutionality; In the process of constitutionality,people often misunderstand the inherent unity of the morals and law, to cause the moral is suffused with legally, thus deviate from the direction governed by law.The article points out China should not ignore the value function of 'proper process'in the process of ruling by law, should draw lessons from the achievement of western practice governed by law, pay attention to the construction and perfection of the procedure law, in the hope of realizing the modernization governed by law of China smoothly.
