摘要
运用文献资料、面访调查法,从均衡NBA各主体权与利的角度,论述了NBA制衡机制的定义、功能、结构、分类及其相互间的关系,进而构建NBA制衡机制理论的全貌。认为:NBA制衡机制由外部、中立、内部制衡机制3部分构成;包括劳资谈判类、公司制度类制衡两类;劳资谈判类制衡机制间的关系为:收益制衡机制是目的,人力制衡机制是途径,而权力制衡机制是手段;公司制度类制衡机制间的关系为:俱乐部层次制衡是基础,联盟层次制衡是补充。
Using the methods of literature and interviewing investigations, and from the angle of balancing the rights and profits of different subjects of NBA, it demonstrated the definition, function, structure, classification of the restrict-balance mechanism of NBA and mutual relationships among them, and then constructed the complete picture of the theory of the mechanism of NBA. It holds that the mechanism is composed of the three parts, i.e. internal mechanism, neutral mechanism and external mechanism, which include the two sorts of the restrict-balance mechanisms of negotiation between labor and capital, and company's system. As for the relation among the former, the restrict-balance mechanism of gains is a purpose, the restrict-balance mechanism of manpower is a way and that of power is means; while the relation among the latter is that the restrict-balance of clubs is basis, and that of union is complement.
