试论中日东海大陆架划界问题

针对解决中日两国之间的东海大陆架划界问题,中国坚持应通过协商在国际法基础上按公平原则划定;日本主张与相关国家的海域划界适用中间线方法。由于海洋划界关系到各当事国家的主权和切身利益,应当坚持公平原则这个根本立场。在此前提下当然必须考虑自然延伸的基本事实,并且如果在某些情况下,采用中间线方法能够达到公平合理的结果,当然有关国家可以通过协议加以使用。

The summary demarcates the problem to solving the continental shelf of East China Sea between China and Japan, China insists that should delimit according to the fair principle on the basis of international law through the negotiation, Japan maintain that demarcates the suitable medium line method with the sea area of the relevant countries. Because demarcate and concern the sovereignty and vital interests of home of every country concerned in the ocean, we should adhere to this basic position of fair principle. Certainly must consider the basic fact that is extended naturally on the premise of this, and if in some cases, adopting the medium line method can reach the fair and reasonable result, certainly the countries concerned can use through the agreement.
