摘要
预告登记制度作为一项不动产登记制度,为德国、瑞士、日本及我国台湾地区的立法所采纳,我国以往的民事立法并没有这项制度。探讨了预告登记制度的理论基础、登记原因、效力、消灭等问题,并在此基础上分析了我国借鉴该制度的现实意义,并对如何在我国建立该制度提出了建议。
The predicting resignation is a kind of resignation for real estate. It is adopted by Germany, Switzerland, Japan and Taiwan. Our country has never had this system in civil legislation. After examing several problems such as the theoretical foundation, the reasons and the effect of the predicting resignation, the author proves the realistic importance for our country, and gives some suggestions on how to build up it.
