略论死者名誉问题

On the Issue of dead person's reputation

近年来,有关侵犯死者名誉的案例时有发生,虽然对于死者名誉需要保护这一点少有异议,但有关保护死者名誉的理论根据却众说纷纭。死者名誉利益的保护和民事权利能力的关系,是首要的且无可回避的问题。保护死者名誉利益而不是权利的提法与民事权利能力理论和其他基本民事制度存在逻辑矛盾。笔者同意名誉权说并提出其保护方法。

Recently there are many cases about infringing of the dead person's reputation. There are no conflicting of protecting the dead person's reputation . But different people have different opinions about the reason.The first problem is the relation of the interests of reputation and the dead person's civil status.This article is about the problem and the author's opinion.
