摘要
契约自由与契约正义的冲突与平衡是契约法发展的必然。对契约自由的必要限制,并不是契约自由的衰落,而是对契约自由原则真实意义的恢复和匡正,是契约自由与契约正义呈现动态统一(协调)的必然。
The development of contract law must confront the conflict and balance of contract freedom and contract justice.The necessary limitation to contract freedom is not the decline of contract freedom but the remedy of the principle of contract freedom and the result of the dynamic harmony of contract freedom and contract justice.
