论胎儿民事权利的保护

On the Protection of Foetus' Civil Rights

随着现代科学技术的进步和现代人权观念的发展,胎儿民事权利的保护变得更加复杂。文章认为,在采取总括的保护主义对胎儿利益进行保护的同时,还应扩大对胎儿民事权利的保护范围。文章在对胎儿具体民事权利加以列举之后,对胎儿损害赔偿请求权的行使程序规则和诉讼时效规定也进行了探讨。

With the progress of modern science and technology and the development of modern human rights idea, the protection of foetus' civil rights becomes more complicated. While taking generalized protectionism for foetus' interests, we should also expand the domain to protect foetus' civil rights. Having enumerated the foetus' civil rights, the author tries to probe into the procedure rules of foetus' compensation for damages and lawsuit period.
