商标侵权为何屡禁不止

自2001年以来,商标侵权假冒案件数量及其在全部商标违法案件中所占的比例存在持续走高的现象,从博弈的角度分析其中三个要素,即打击侵权的成本、罚款数额和非法经营额。结果表明造成该现象的主要原因在于罚款数额与非法经营额相关关系弱,罚款数额不足以对商标违法起到惩戒作用。

The paper aims at the phenomena of the increasing counterfeit trademarks cases and its proportions in all cases against Trademark Law since 2001.It analyzes it from the game perspective.There are three main factors including combat cost,forfeit amount and illegal turnover.It concludes that the main cause is the poor correlationship between forfeit amount and illegal turnover,in which the former for its insufficiency seldom exerts the warning effect on the latter illegal practices.
