从贸易保护与公平竞争之博弈看中国反倾销立法之完善

Legislation Perfection of Chinese Anti-dumping Law With the Combat between Fair Competition and Trade Protection

反倾销法是一柄“双刃剑”,既可以促进自由贸易与公平竞争,亦被某些国家滥用为贸易保护的壁垒。笔者认为,欲在二者间取得平衡,即应将反倾销法的条文细致化,加强其可操作性。于此前提下,笔者进而分析了中国现行反倾销法存在的不足,并针对不足之处提出了自己的修改建议。

The anti-dumping law has two sides: promoting free trade and fair competition as well as being abused as the protective barrier of trade by some nations. The writer believes that to obtain the balance of the two aspects, we shall itemize the anti-dumping clause, strengthen its maneuverability. So, the writer analyzes existing shortages of Chinese current anti-dumping law, and proposes some modification .
