人民陪审员制度与人大监督

The People’s Assessor System and the Supervision by the People’s Congress

20 0 4年8月2 8日第十届全国人民代表大会常务委员会第十一次会议通过关于完善人民陪审员制度的决定。2 0 0 5年5月1日,我国新的人民陪审员制度正式实施。新的人民陪审员制度实行的是陪审员由法院和司法行政机关共同管理的体制,笔者认为这是一种不伦不类的管理体制,这是权力的妥协,而不是权力的平衡,新的人民陪审员制度应该建立一种由人大常委会来管理的体制,人民陪审员的作用主要是监督。

The 11th session of the 10th Shanding Committee of the National People’s Congress abopted the Desision on the Improvement of the People’s Assessor system on August 28, 2004. Our country’s new system of the People’s Assessor will be carried out on May 1, 2005. According to the new system, a people’s assessor is managed by law courts and administrative department of justice. The writer thinks the new system is the results of prwer compromise and it is not rational. The writer believes that the new People’s Assessor System should be administered by the Committee of the People’s Congress. The function of the People’s assessor is to supervies and restrict the full-time judges to protect the human rights.
