Legitimate Subject vs Legal Subject

在分析法治和主体的概念后,发现法治和主体的本质是契合的,都是以自由为最高的祈求和永恒的目标。提出“法治主体”概念,认为具有独立、自由和解放,世俗性、此岸性、此生性,理性,个性尊严的个人才是法治主体。本文以此作为检验某一特定社会是否达到法治社会的标准。在比较了“法治主体”和“法律主体”后,分析了提出法治主体概念的意义。

After analyzing the concepts of rule by law and subject, the paper discovers that the true nature of two concepts are consistent. Those all regard freedom as the highest imprecation and the eternity target. The paper puts for- ward legitimate subject and shows it contains four provisions: independence,freedom and liberation;customs,the sideness and life; reason and personal dignity.And regards it as the standard of the society ruled by law.Then this paper contrasts legitimate subject and legal subject and analyzes the importance of legitimate subject.
