民主政治已经成为世界政治形式的主流,中国也把发展社会主义民主政治作为全面建设小康社会的目标,并将"依法治国"写进最新修订的宪法。通过对西方民主政治发展轨迹的考察,认为发展民主政治,必须解决权力与权利的制衡问题,而解决的途径便是法治。民主与法治的结合是一个渐进的过程,宪法的产生是这一过程发展到一定阶段的产物,标志着民主与法治的全面融合。中国要发展社会主义民主政治,最重要的是要正确认识宪法的地位与作用,树立宪法至上的观念。

With the democratic politics being the mainstream of the world political form, China is now taking the socialism democratic politics as the destination of building a moderately prosperous society of a higher standard in an all-round way, and putting 'ruling the country by law' into the newly-revised Constitution as well. By tracing the development of the democratic politics in western countries, this article holds that the restraining relations between power and rights must be considered in the course of developing the democratic politics and the legal system is the only solution. It's a gradual process to combine democracy with the legal system. Therefore, the Constitution comes into being when this process develops into a certain stage, which marks the merging of democracy and the legal system. In order to develop the socialist democratic politics in china, what's the most important is to understand correctly the position and role of the constitution and to set up the conception of the Constitution's paramountcy.
