西部开发法引入诚实信用原则刍议

由于我国长期游离于市场经济之外,市场信用建设极为滞后,市场信用状况堪忧,这已引起各界重视。在西部开发中,也存在严重的信用缺失问题。作为一种价值形态和标准的诚实信用原则,首先为私法所接纳和繁衍,后来向公法渗透,几已成为统摄私法和公法的重要原则。作为以公法性为主兼具私法性的西部开发法,在几年以来的西部开发实践凸现信用缺失的背景下,引入诚实信用原则,极具现实意义。

State benefits promote international systems. The benefit is a combination of the subjective and the objective,appearing in the process of recognition and practice. The nature of system is a combination of productive forces and production relations, which is relatively independent. So international systems, once it comes into being, are not completely passive in the relations of international systems and national benefits, which is relatively independent and will educate, direct, guarantee, limit and promote national benefits. What role a nation plays in international systems is very important to its benefits. China should participate in formulating and carrying out international systems in order to win the guard of international systems for the national profits.
