摘要
对行政裁量法律控制机制进行研究,论证了权力机关对行政裁量的法律控制,在分析我国权力机关进行监督现状的基础上,提出应当借鉴一些国家实行的议会监察专员制度并结合我国国情加以改造使之符合我国的法治实践,对完善我国权力机关对行政裁量的监督提供了参考思路。在论证行政机关对行政裁量的法律控制时重点放在行政程序对行政裁量的法律控制上,对行政程序控制行政裁量的回避制度、听证制度、信息公开制度、参与制度、说明理由制度、职能分离制度进行了初步探讨。具体分析了司法机关对裁量的法律控制,提出了行政裁量权属于行政机关,司法机关不能审查,行政裁量属于行政权的运用活动、司法机关可以审查的观点,说明了审查的范围只限于行政裁量的合法性,在认定滥用职权的主观方面时主张采用“过错推定”的原则。结束语说明现代社会对行政机关提出的是积极进行行政裁量更好地为社会服务的要求,现代行政法上的行政裁量制度是以有效发挥行政裁量权的积极作用为目标。提出建立一支高素质的公务员队伍、提高公务员的依法行政意识和依法行政水平应当是解决行政裁量问题的最终途径,完善岗位责任制、发展责任控制模式是对行政裁量进行法律控制的最佳方案。
Through the research of the law controlling administrative discretion, the thesis has given some suggestions for improving the supervision by the legislative authorities for the administrative discretion, expounded the fact that the law control to administrative discretion by the inner rule of administrative authorities and administrative procedure, proposed that administrative discretion power belongs to the administrative authorities, it can not be reviewed by courts, at the same time, administrative discretionary act is the act of exercising of administrative discretion power, it could be subject to judicial review. For finding the subjective aspect of illegal administrative discretion, the principle of ' the fault is inferred' shall be employed. The key about how to solve our country administrative discretion problem is that to set up one high-quality civil servant team, increase the consciousness and enhance the level of civil servant about administration according to law. It is undoubtedly that developing responsibility control mode, perfecting work responsibility system and illegal responsibility investigation is the best way in our country to control administrative discretion by law.
