论我国电信运营商之间互联互通纠纷的司法管辖权

On the Judicial Jurisdiction of Dispute Concerning Interconnection in Telecom between the Telecom Service Providers

国内电信运营商之间因互联互通纠纷引发的司法管辖权争议,由于种种原因尚未得到妥善解决。利用司法救济手段解决互联互通争议,最终有待于最高人民法院的司法解释或未来电信法作出明确的决定。

This article, through introducing a case concerning interconnection between two famous Telecom operators, analyzes the causes in jurisprudence, forwards the underlying problem in China about Telecom's jurisdiction related to interconnection, and illuminates the significance of establishing the legal assistance in this area at present. The final part makes the conclusion that the Supreme Court's judicial interpretation to the pertinent law and the specific regulation in the forthcoming Telecommunication Law have been given much expectation to eradicate the problem.
