中国民法典制定现状及主要问题

Drafted Conditions and Main Problems of China’s Civil Code

中国民法典的制定是中国法学界的盛事,亦是中国立法与中国经济社会发展的必然。然而,对于这一宏大的立法工程,中国民法理论以及整个法学理论的准备不足是显而易见的。通过现今物权法制定过程中经验的积累和探索,制定科学的民法典需要解决三大问题:1)必须克服前苏联法意识形态,因为它与市场经济体制下的民法典难以相容;2)必须进行扎实的实践调查;3)必须提高民法科学法律技术研究水平,以科学的态度对待民法典立法,建立科学的规则体系。

The formulation of Civil Code of China is the grand occasions of the Chinese jurisprudential circle, also is inevitable that legislates and socio-economic are developed. But, hereto mighty legislative project, it is obvious that the preparation of China’s civil law theory and the whole law theory is insufficient. Through the accumulation and exploration of the experience in Real Right Law formulation process now, it needs to solve three problems to make scientific Real Right Law:1)We must overcome ideology of the former Soviet Union law,Incompatible because of Civil Code under it and market economic system. 2)We must carry on the sturdy practice to investigate. 3) We should improve the law technical research level of the civil law science, treat the legislation of Civil Code in China with the scientific attitude, and set up scientific regular system.
