The Principles of the Distribution of the Burden of Proof

证明责任具有主观证明责任与客观证明责任双重含义。证明责任制度的核心是证明责任分配。大陆法系国家通常采用形式标准,英美法系国家一般采取实质标准来分证明责任。最高人民法院颁布的《关于民事诉讼证据的若干规定》借鉴两大法系的优势,制定出适用我国的三项证明责任分配规则:基本规则、特殊证明责任分配和衡平原则。

The mainland countries usually adopt the shape criterion .The system of Britain countries ordinarily take essence criterion .The Supreme Court has carried out 《The Several Provisions On Evidence in Civil Proceedings 》. It has set up three principles of the distribution of the burden of Proof in our country civil proceedings.
