摘要
宪法基本权利条款应当具有直接效力,这是宪法法律性的必然推论,也是宪政人权的内在要求。但宪法规范在私法领域的直接适用,需要确定合理的方式,其本质是要明确宪法价值的取向。
<Abstrcat>The provision of constitutional basic right should have direct effect, which is inference of constitutional state of law and also the internal requirement of of human rights. But the application of constitutional standard in the field of private law needs a reasonable way. Its essence is to clarify the constitutional value.
