中国古代法律是伦理化的法律,研究家族犯罪对揭示中国古代法的精神有着重要的意义。以年代为序,从通论性与断代性著述两个层面上对秦汉时期家族犯罪的研究情况作了梳理,在充分肯定前人成就的同时,对这一领域研究的不平衡作了分析。

China's ancient law is the law of ethics,and studies of family crime are of great significance to announcing the spirit of law of ancient China.From the general and dynastic perspective the studies of family crime in the Qin and Han dynasties are well-organized and analysed while affirming fully predecessors' achievements.
