On Classified Administration of Procuratorial Personnel

淡化行政色彩,增强司法属性是检察改革的必由之路,检察权的行政性与司法性需要重新归位,检察机关的性质和人员的高效管理决定了分类管理可以作为整合多项改革措施的基本载体,也是推进检察职业专业化的有效途径。本文以分类管理改革的动因和目标为切入点,在检察改革的整体规划中考察分类管理的必要性和可行性,探索相对合理的过渡模式,为试点实践提供参考。

Diluting the executive character and enhancing the judicial attribute is the only way of procuratorial reform,and the executive and judicial nature of the procuratorial power should be rearranged.Classified administration may serve as basic carrier of multiple reform measures and available approach to advance the professionalization of procuratorial personnel to adapt to the character of procuratorial organ and effective personnel management.With the access of the cause and purpose of classified ad- ministration,this article analyzes the necessity and feasibility of classified administration in the integrated project of procuratorial reform,and explores comparatively rational transitional mode for practical reference.
