20世纪西方社会法学在中国本土的变革——以庞德的社会法学为例

The Transformation of Western Sociological Jurisprudence in China in the First Half of 20^(th) Century——Taking Pound as an Example

19世纪末兴起的西方社会法学,对20世纪上半叶的中国法学产生了广泛的影响,但西方社会法学传入中国之际却发生了重要变革:本质上维护个人权利的社会本位法学被转换成为支持国家权力的国家本位法学。笔者将以庞德为例深入分析这一变革及其发生的原因,力透中国法律近代转型的轨迹。

In the first half of 20^(th) century,Western sociological jurisprudence had a great impact on Chinese legal ideas and practices.By describing some specific influences of Western sociological jurist Pound on Chinese social jurisprudence,this paper tries to inquire into changes of Western sociological jurisprudence after its introduction into China,thus understanding the tendency of law transition in modern China.
