The Trends of Modern Property Law and Its Impact on the Legislation in China

现代物权法的发展趋势可以概括为物权法编制的体系化、物权法本位的社会化、物权理念的价值化和物权种类的现代化四个主要方面。这些发展趋势对于我国物权法的制定和物权制度、规则的设计,具有重要的启示意义。我们应在贯彻坚持权利本位、兼顾社会公益,面向21世纪社会发展的需要、顺应物权法的现代发展趋势,立足本国实际、尊重中国国情这三个基本指导思想的前提下,妥为取舍,制定出适合中国社会主义市场经济发展需要的、先进的物权法。

The trends of modern Property Law present four aspects: the systematization of the codification of Property Law, the socialization of the principle of Property Law, the value of the idea of real rights and the modernization of the classification of real rights. These trends have important impact on the legislation and the design of the real rights rule in China. We should stick to the right principle coupled with public interest,meet the need of the 21th century and fit the trends of modern Property Law based on the practice in China. In the light of the above mentioned fundamental guiding ideas, we should make a good choice and legislate Property Law which meet the need of socialist market in China.
