On the Double Real Right Alternating Mode of the “Real Right Law”

以登记合同成立模式为起点,我国上世纪80年代以来的物权变动模式立法逐步形成了债权形式主义和对抗主义两种模式并存的格局。作为一种与古典绝对物权观对应的模式,债权形式主义不仅割裂了模式构造与现代物权法的权利基础———观念物权之间的内在联系,违背了物权观念和物权变动模式演进的历史规律,也为一物二卖、物权行为理论提供了土壤,未来物权法应当以科学的对抗主义统一物权变动模式。

Starting from the mode of “contract established by register”, the legislation of real right alternating mode has formed from 1980s into two kinds ——debiting contract mode and competing one.As an old mode originated in old real right, debiting contract mode not only severs the relation between the mode and the modern real right concept, but also runs counter to the historical rule of the evolution of real right concept and real right alternation mode. At the same time, it provides the condition of repeating selling and juristic act of real right.The coming Real Right Law should adopt the scientific mode of competing one to uniting the real right alternation mode legislation.
