晚清司法改革实践与反思

The Practice and Rethinking of the JudiciaI System Reform in the Late Qing Dynasty

通过借鉴、移植国外司法制度,晚清政府进行了建立新式司法制度的司法改革,并取得一系列的成果。然而,由于晚清司法改革是在特定历史条件下进行的,司法改革更多的是注重在法律形式方面与外国接轨而忽视本国的实际,因此,这必然导致司法改革无法达到预期的效果。但是,晚清司法改革实践为眼下法律移植提供了宝贵的历史经验。

Through transplanting the foreign judicial system,the late Qing government carriedout the judicial reform movement to establish the new judicial system and bore a series of fruits.But the judicial system reform was processed in the special social condition, so, the reformer paid more attention to the link with the foreign system in legal form than to the conformity with native social facts, which consequently caused the expected effect of the judicial reform not to be realized.On the other hand, the practice of the judicial reform in the 1ate Qing Dynasty offered some valuable historical experience for legal transplantation nowadays.
