摘要
运用比较的方法探讨商业秘密与专利的关系。从保护范围、条件、公开程度、有效期限、权利、法律保护、费用与风险等方面分析了商业秘密与专利的区别，以此作为技术发明人选择商业秘密与专利法保护时的权衡因素。并讨论了商业秘密与专利的冲突，第一发明人／商业秘密持有人与第二发明人／专利权人之间的关系，商业秘密与专利的结合方式以及商业秘密与专有技术这两个概念的区别与联系。
This paper is a study of the relationship between trade secrets and patents.It deals with the conflicts between trade secrets and patents,their modes of combination and the difference between trade secrets and know-hows.
