Xinguang case is the kind of the cases that the urban planning departments are often meet with in nowadays China. The defendant changed the nature of the land use, Seted up the entrance and exit for the vehicles and enlarged the building area without authorization. This action is seriously against the 'City Planning Act'. The court verdict given by the Guangzhou Municipal intermediate People's Court and the Guangdong Provincial Higher People,s Court maintained the opinion of the planning department.The author analysis the legal issues concerning the case, which reflects on the one hand some progress of the building -up of the planning laws and on the other some difficulties the planning departments are still facing.
