关于构建我国违宪审查制度的思考

On Thinking of Setting up Unconstitutional Examining System in China

违宪审查制度是现代法治国家法律制度的重要组成部分。我国现行宪法对违宪审查制度虽有明文规定,但却存在诸多不完善的地方,违宪审查缺乏有效性及可操作性。为了保证宪法的有效实施,我国必须尽快建立起符合本国国情的违宪审查制度,设立相对独立的专门的违宪审查机关,使违宪审查工作专业化、专门化、技术化、经常化。

The unconstitutional examining system is an important composition part of law system in the moden legal ruling country. Though China＇s current constitution has a regulation to the unconstitutional examining system, iexists many non-perfect places, the unconstitutional examining system lacks the effectiveness and operability. For the sake of the effective implementation of the constitution, our country must build up the unconstitutional examining system consistent with Chinese own situation as soon as possible, establish relatively independent unconstitutional examining organization, to make the unconstitutional examining work professional, specialized, technological and conventional.
