从TRIPS协议看我国新《商标法》的完善和发展

Seeing the perfection and development of the new Trademark Law of our country from the TRIPS

TRIPS协议,即《与贸易有关的知识产权协议》是有关知识产权国际保护的重要协议,也是WTO协议的重要组成部分。WTO成员国包括《商标法》在内的知识产权立法应与TRIPS协议的要求相一致。我国新《商标法》适应我国加入WTO的需要,在许多方面进行了完善和发展。从TRIPS协议的角度看,这些完善和发展包括:注册商标的种类、注册商标的可视性和显著性、驰名商标和地理标志的保护、临时措施和商标确权终局问题、官方标志的禁用、优先权问题等若干方面。

The TRIPS, namely The Treaty about the Right of Intelligent Property in Tradion ,is an important treaty concerning international protection of intelligent property right, and is also an important part of the WTO treaty. The making of intelligent property right law including the Trademark Law of the member of WTO should be in accordance with the request of the TRIPS. the new TRADEMARK LAW of our country should be perfected and developed in many respects so that it can orientate the demand of the situation after our country join the WTO. seeing from the TRIPS, these perfections and developments include ： the category of the registered trademark, the character being seen and the differentiation of the registered trademark, the protection of the famous trademark and the the protection of the geography mark, the temporary measure and the problem about the lasted power on assurancing trademark right belongs to someone, the marks of authorities being forbided to use, the priority problem.
