摘要
中国法律对生育权的承认,是完善公民权利体系的重大进步。但由于生育并非纯粹的私人权利,它与国家和公民关系,与未出生儿童权利以及国家的前途命运相关,因此,国家有责任有义务通过法律和社会保障制度对其加以限制。
The civil procreation right has been admitted by Chinese laws. It is a great advancement of improving the system of civil rights. However, this right is not a pure personal right because it concerns the right of unborn children and the fate of the country. So it is a responsibility and obligation for the nation to adjust the procreation right with laws and social safeguard systems.
