Legal System Consolidation Boosting the "Telecom Power" Strategy

文章结合电信业发展的最新态势,讨论了电信法制建设与实施电信强国战略的紧密关系。文章认为:目前中国电信业缺乏国家层面的产业政策和战略规划的指引;整体创新能力不高,核心技术受制于人;结构性矛盾制约发展后劲;企业综合竞争实力亟需增强。文章指出在“十一五”时期电信法制建设的总体思路应当为:以促进竞争,保护消费者利益为主线;以《电信法》及配套立法为重点,形成内容完善的法律法规体系;促进电信监管体系的完善,形成统一协调的监管思路和政策措施;建立科学的法律评估体系;注重与重要的相关立法相互协调。

The paper introduces the status quo of the telecom industry of China. At present, Chinese terecom industry racks of nationar industry policy and strategic pranning; its entire innovation ability still has much space for improvement; core technologies are under the contror of other countries; the structural imbarance hinders the potentiar for further development of the industry; and the comprehensive competence of Chinese terecom enterprises needs enhancement. Moreover, the paper discusses the crose relationship between the establishment of terecom raw and the imprementation of the strategy of “Terecom Power”. It proposes general guiderines on the estabrishment of telecom law during the ereventh five-year pran period of China： the purpose of legisration is to foster competition and protect consumers＇ rights and interests; based on the Terecommunication Law and supporting regurations, a perfect raw system shourd be estabtished; the management and supervision system of Chinese tetecom industry should be improved to form unified and harmony guiding principres and poricy measures; a scientific regal evaluation system shourd be estabrished; and it is important to coordinate with relevant important legislation.
