摘要
本文阐述了美国外汇衍生品市场的监管体制,介绍了与外汇衍生品监管相关的法案和判例,对场外和场内外汇衍生产品监管的区别进行了比较,在此基础上,分析了我国目前开展外汇衍生品及其监管现状。本文建议,未来我国货币衍生产品的监管要注意从国家层次立法和明确监管部门的职责划分。
This paper is a clarification of the supervisory system of US foreign exchange derivatives. It brought about the relevant bills and cases and compares the different standards of supervising exchange products and OTC products. Based on a review of China＇ s status quo in this field, it is proposed that China should state legislation should catch up, with a clear specification of rights and obligations of each competent agencies.
