摘要
现有的人身危险性的理论研究,其视野过于狭窄,并且偏重于对功利性的研究,导致对其研究过于僵硬,从而造成实务中的适用混乱。对人身危险性含义及其确定范围地把握,既应该服务于预防犯罪的目的,也不能脱离于正义的要求。
The view of present human danger theory research is very limited and prefers to practical research, which led to its being rigid, and caused the mixture in the real practice. The managing of the human danger and its range should both serve for preventing committing crimes and not be separated from the requirement of justice.
