论我国诉讼制度中的司法鉴定

Expert Testimony in Judicial Process of China

司法鉴定是指在诉讼过程中对案件中的专门性问题,由司法机关指派或当事人委托,聘请具有专门知识的人对专门性问题作出判断的一种活动。根据我国诉讼制度中司法鉴定的产生、发展、现状和《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》,应特别重视解决鉴定机构的独立性、从事司法鉴定工作的机构和个人的资质条件、鉴定人出庭作证制度、监督管理的措施和责任等问题。

Expert testimony is a kind of providing evidence activity made by profesional expert ,whom are assigned by judicial department or employed by litigant,on some special problem in the judicial procedure.This article not only briefly introduces the birth and developement of expert testimony in judicial prodcedure,but also gives some advice for the judicial system of our country after the publication of Decisions on Judicial Testimony by People＇s Congress Standing Committee.
