摘要
工作场所性骚扰行为在我国已经成为一个严重的问题。本文立足于中国当前性骚扰普遍存在的社会现实,参考美国工作场所性骚扰的传统理论和制度,从我国现行法律和司法解释入手分析,指出工作场所性骚扰应承担侵权法律责任,最后对《妇女权益保障法》修正案中关于工作场所性骚扰的条文提出了加以完善的立法建议。
Sexual harassment in the workplace gradually becomes a tough problem in China. This article is an analysis on the traditional theory and system in western cotmtries of sexual harassment in United States and its existing phenomena in China by means of studying the present statutory law and juridical interpretation document, and by means of indicating the tort legal liablility on sexual harassrnent in the workspace. Finally the author performs legislative suggestion for the amendment of the Law of the People's Republic of China on the Protection of Rights and Interests of Women about forbiddening sexual harassment in the workspace.
