摘要
美国宪法《权利法案》第四、五、六条修正案所规定的内容并非仅仅是刑事程序,而是公民的宪法刑事程序权利。美国学界主流观点与司法实务判例对这些修正案的误读,导致有利于罪犯却伤及无辜的后果。通过重新赋予这些条款以宪法权利属性,阿玛尔认为可以避免颠倒事实和压制真相,起到打击犯罪、保护人民的作用,并体现宪法的人民性。对该问题的研究,客观上有利于在回应全球司法改革趋势的前提下,思考我国的司法改革对策,并可帮助廓清宪法权利与公民普通法律权利之间的界限。
The articles contained in the Fourth, Fifth and Sixth Amendments of the Bill of Rights, American Constitution, are not simply criminal procedures, they are also constitutional criminal procedural rights enjoyed by citizens as a whole. The misreading of these amendments by leading American constitutional law scholars and cases handled has led to the consequence that rewards the guilt while hurting the innocent.Akhil R. Amar, an expert of constitutional law, believes that through refurbishing the nature of constitutional rights embedded in these amendments, and stressing the importance of constitutional methodology, we may avoid an upside down and truth - suppressing remedial scheme. The popularity of the constitution can also be demonstrated effectively. The study on constitutional criminal procedural rights will benefit us to respond to the trend of global judicial reform, consider carefully the policy of judicial reform and help clear the distinction between constitutional rights and general legal rights.
