环境容量是描述环境要素纳污能力的自然科学表述。作为一种自然力的功能性载体,由于其具有可感知性、可确定性和相对的可支配性,因此具有成为准物权权利客体的可能。以其为客体而生成的准物权称为排污权,具有使用、收益等基本的用益物权属性,是我国推行环境要素市场化配置、履行《京都议定书》的重要法律基础。

The right that established on them can be named as emission right, which includes the purview of usufruct and proceeds.
