On the Application of Presupposition Strategy in Cross Examination

交叉询问是英美诉讼中一项重要的证人盘问制度。对于进行交叉询问的律师而言,策略运用是获取理想证词的有效手段。从语用预设的角度来研究交叉询问中的策略运用,我们认为,采用预设语是询问律师行之有效的一种策略方式。预设策略的运用具有很大的正面意义,但其潜在的负面影响也不应被忽略。

Cross - examination is an important witness questioning system in Anglo - American litigation. For lawyers who undertake the cross examination, application of strategy is an effective way to elicit desirable testimony. This paper attempts to study strategy in cross -examination from the perspective of pragmatic presupposition, holding that employment of presupposition triggers is an effective strategy for lawyers undertaking the examination. Application of presupposition strategy has substantial positive effects; nevertheless, the potential negative effects of it should never be neglected.
